PSC-Led CODSIA Comments on DFARS FOCI Proposed Rule

PSC led the development of comments submitted by the Council of Defense and Space Industry Associations (CODSIA) on DFARS Case 2021-D011, Mitigating Risks Related to Foreign Ownership, Control, or Influence. The comments support the Department of War’s national security objective of identifying and mitigating foreign ownership, control, or influence risks, while urging clear, acquisition-compatible implementation procedures.
CODSIA recommends that the final rule:
- Preserve competition
- Clarify the $5 million applicability threshold
- Provide early solicitation notice
- Define the commercial-products and commercial-services determination process
- Ensure DCSA and NISS readiness
- Protect sensitive ownership information
- Make mitigation timelines workable and risk-based
