PSC Comments on RFO FAR Part 33 - Protests, Disputes and Appeals
On Monday, October 6, 2025, PSC submitted
comments
to the Office of Management and Budget regarding its Revolutionary FAR Overhaul FAR Part 33 Model Deviation, which sets policies and procedures for protests, disputes, and appeals. PSC recommended that OMB and the FAR Council remove some sections of its purpose statement, the language of which undercuts PSC's long-standing perspective that the fundamental purpose of the bid protest is to hold U.S. government agencies accountable,
helping ensure that processes and the resulting decisions align with statute and regulations and that procurement procedures are conducted in an appropriately transparent manner. PSC recommended instead that, if the FAR Council wishes to reduce protests, it instead include statutory and common-sense language into FAR Part 15, such as enhanced debriefings.
