PSC Comments on FTC Changes to Hart-Scott-Rodino Notifications
On August 28, 2023, PSC submitted comments on the FTC proposed rule to amend premerger notification rules that implement the Hart-Scott-Rodino Antitrust Improvements Act. PSC made several recommendations that would (1) provide for a national security exception to certain requirements, (2) protect classified and other sensitive information, (3) apply the rule to only high-risk transactions only, and (4) clarify certain terms and applicability of requirements.
