MEETING DESCRIPTION
Join our virtual meeting of the PSC General Counsels Committee on August 20, 2024, at 1pm ET to discuss the recent SCOTUS ruling that overturned the long-standing "Chevron deference." All PSC members are welcome to attend.
The court's June 2024 ruling in Loper Bright Enterprises v. Raimondo:
- Well-publicized ruling which signified a reversal of the long-standing "Chevron deference"
- May significantly impact government contractors, as well as their agency customers.
|
Note: In the 1984 Chevron case, the court ruled that if Congress had not directly addressed the question at the center of a dispute, courts must uphold the agency’s "reasonable interpretation of statute.
Discussion topics will include:
- How agencies, Congressional offices, and lower courts are interpreting this SCOTUS ruling and what actions, if any, they are taking?
- What impacts we are already seeing among government contractor?
- e.g., the Federal Trade Commission's final rule to ban non-compete agreements, FAR Council and Securities & Exchange Commission reporting requirements for cybersecurity incidents.
- What we are watching and what future consequences might be?
