CMMC Challenges, Disputes and Protests: What We Know & Don't

DESCRIPTION
The DoD Cybersecurity Maturity Model Certification (CMMC) program, and its newly released DFARS cybersecurity interim rule, lay the groundwork for enhanced assessments of contractors’ cybersecurity compliance as a condition of doing business with DoD. The private sector non-profit CMMC Accreditation Body (CMMC-AB) has important roles and responsibilities for the success of CMMC, and more actions by the CMMC-AB will be necessary. But as companies assess the requirements for success in implementing the DoD CMMC program, there are numerous questions being raised about what options will be available to companies to challenge, dispute or protest actions or decisions by DoD, the CMMC-AB, and third-party assessors responsible for verifying contractors’ compliance. Cybersecurity non-compliance also presents new False Claims Act risks for industry.  There is a lot we already know but also areas still be to definitized. This program will provide an overview of the multiple avenues of decision-making in the DoD CMMC/DFARS cybersecurity program and what considerations companies should be aware of to anticipate and manage potential disputes related to CMMC/DFARS at various stages, and to mitigate exposure to False Claims Act liability. Speakers include PSC Executive Vice President and Counsel Alan Chvotkin and Alexander Canizares, senior counsel at PSC member company Perkins Coie.
