PSC Comments on DoJ / FTC Draft Merger Guidelines
On September 18, 2023, PSC submitted comments on the draft update of “Merger Guidelines” released recently by the Department of Justice and Federal Trade Commission. These guidelines detail how the agencies will review mergers and acquisitions to determine compliance with federal antitrust laws. PSC's comments focused on the proposed methodologies and resources to determine "potentially illegal mergers", as well as the applicability of such guidelines when the Government is the primary—and often only—customer.
